Terms of Use

These Terms of Use ("Terms") apply to happycowcolorado.com (the "Site"), our email list, and any promotions we offer through them. The Site is operated by The Happy Cow LLC ("The Happy Cow," "we," "us," or "our"), located at 2902 W Colorado Ave, Colorado Springs, CO. By using the Site or joining our email list, you agree to these Terms. If you don't agree, please don't use the Site.
2. Allergens & Dietary Needs
Our kitchen handles common allergens, including milk, eggs, and wheat, and ingredients we use may contain or come into contact with others. All of our food is prepared in a shared kitchen with shared equipment, and all frying is done in beef tallow.
"Gluten-free" and other dietary labels describe the ingredients we use — not a guarantee. Our fryer is wheat-free, but because we share preparation areas and equipment, we cannot guarantee that any item is free of gluten or any other allergen, and our kitchen is not certified gluten-free. If you have a food allergy, celiac disease, or other dietary restriction, please tell our staff before ordering, and use your own judgment about whether to eat with us.
3. Food Safety Advisory
Some of our items contain raw-milk (unpasteurized) cheese. Consuming raw or undercooked meats, poultry, seafood, shellfish, eggs, or unpasteurized dairy may increase your risk of foodborne illness, especially if you are pregnant, elderly, very young, or have certain medical conditions. Ask our staff if you have questions about how any item is prepared.
4. Health & Nutrition Information
The Site shares our food philosophy and our family's personal story, including information about ingredients such as beef tallow, A2 dairy, and grass-finished beef. This content is for general informational purposes only. It is not medical, nutritional, or health advice, and it is not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration. Talk with your doctor or a qualified health professional before making changes to your diet, especially if you have a medical condition.
5. Online Ordering
Online orders are placed and paid for through Toast, a third-party ordering platform. When you order through Toast, your order, payment, and personal information are handled under Toast's own terms and privacy policy, not these Terms. Questions about a specific order can be directed to us using the contact information below.
6. Promotions & Discount Codes
From time to time we may offer discounts, including a welcome discount for joining our email list. Unless the offer itself says otherwise:
- Welcome discounts are sent only after you confirm your email address.
- Limit one welcome discount per person. Creating multiple accounts or using multiple email addresses to receive additional discounts is not allowed.
- Discounts are redeemable in person at our counter only and cannot be used for online orders unless we say so.
- Discounts apply to a single order, cannot be combined with other offers, and do not apply to gift card purchases, taxes, or gratuity.
- Discount codes have no cash value, cannot be exchanged for cash or credit, and cannot be sold or transferred.
- Offers may expire as stated in the offer, and we may modify or end any promotion at any time without notice.
- We may refuse or void any discount that we reasonably believe was obtained or used fraudulently or in violation of these Terms.
7. Email Communications
By joining our email list, you agree to receive marketing emails from The Happy Cow about menu updates, specials, events, and promotions. We send a confirmation email first, and you're only added once you confirm. You can unsubscribe at any time using the link at the bottom of any email we send. Our email list is managed through Mailchimp, a third-party service. We don't sell your email address.
8. Gift Cards
Gift cards are subject to the terms provided at the time of purchase and to applicable Colorado law. Please treat gift cards like cash; we are not responsible for lost or stolen cards.
9. Acceptable Use
When using the Site, you agree not to:
- use the Site for any unlawful purpose or in violation of these Terms;
- submit false information or someone else's email address without their permission;
- use bots, scripts, or other automated means to access the Site or sign up for our email list;
- interfere with or attempt to disrupt the Site's operation or security; or
- copy or reuse the Site's content except as allowed below.
10. Our Content
The Happy Cow name, logo, text, photos, and design of the Site belong to The Happy Cow LLC or our licensors and are protected by law. You may view and share links to the Site for personal, non-commercial purposes. You may not copy, reproduce, or use our content or branding for commercial purposes without our written permission.
11. Third-Party Links
The Site links to third-party services, such as Toast for online ordering and Mailchimp for email. We don't control those services and aren't responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.
12. Disclaimers
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
13. Limitation of Liability
To the fullest extent permitted by law, The Happy Cow LLC and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Site, our email list, or any promotion. Our total liability for any claim related to the Site will not exceed one hundred dollars ($100).
Nothing in these Terms limits any liability that cannot be limited under applicable law.
14. Indemnification
You agree to indemnify and hold harmless The Happy Cow LLC and its owners and employees from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.
15. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Site will be resolved in the state or federal courts located in El Paso County, Colorado, and you consent to the jurisdiction of those courts. If any part of these Terms is found unenforceable, the rest will remain in effect.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we'll change the effective date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
